IMPORTANT: This Privacy Statement applies only to general website visitors and marketing communications. If you are a client receiving healthcare services from us, the collection, use, and disclosure of your Protected Health Information (PHI) is governed by our separate HIPAA Notice of Privacy Practices, which you will receive at or before your first appointment. That notice describes your rights under HIPAA and how we may use and disclose your health information.
By using the Site, you agree to the data collection, use, disclosure and storage practices described in this Privacy Statement.
This Privacy Statement is for informational purposes and sets forth our policy with respect to the collection, use, and disclosure of non-PHI information that we collect through the Site when engaging with prospective clients and website visitors. This Privacy Statement does NOT apply to Protected Health Information collected from clients in connection with healthcare services, which is governed exclusively by our HIPAA Notice of Privacy Practices provided separately. By using the Site, you agree to the data collection, use, disclosure, and storage practices described in this Privacy Statement and the terms set forth in our Terms of Use.
The Bare Facts provides health education and information to individuals located in Massachusetts.
We do not intentionally collect personal information through our Site, other than contact information (such as email addresses and phone numbers) used by individuals age 18 and over to contact us to schedule appointments or request information about our services.
Once you become a client and we begin providing services to you, any Protected Health Information we collect, use, or disclose is subject to our HIPAA Notice of Privacy Practices, Business Associate Agreements (where applicable), consent forms, and other documents that we provide to you at or before your first appointment. We are required by law to maintain the privacy and security of your Protected Health Information and to provide you with notice of our legal duties and privacy practices.
We may obtain information about you from other sources, including social networks that you use to connect with The Bare Facts. This information may include name, user name, demographic information, updated address or contact information, interests, and publicly-observed data, such as from social media and online activity. This information collected is governed by the social network site terms and privacy policies. We do not use this information when we provide healthcare services to clients, and such information does not become part of your medical record or Protected Health Information. We maintain strict separation between marketing/website information and Protected Health Information as required by HIPAA.
We do not automatically collect information from you as a Site visitor whenever you access or interact with the Site. We do not use cookies, web beacons, pixel tags, log files, or other technologies to automatically collect certain information when you use our Services or interact with our emails and online or mobile advertisements.
We have implemented physical, administrative, and technical safeguards to protect the information we collect from and about our clients and Site visitors. For Protected Health Information collected in connection with healthcare services, we maintain security measures that comply with the HIPAA Security Rule, including:

We are required by law to abide by the terms of the HIPAA Notice of Privacy Practices currently in effect. Any material changes to how we use or disclose Protected Health Information will require us to provide you with a revised HIPAA Notice of Privacy Practices, and we cannot make material changes to the use or disclosure of your PHI that were not described in the notice you received without providing you with a revised notice. We will not apply material changes retroactively to PHI we collected under a prior notice without your authorization, except as permitted by law.
